Terms of Service

PixelVerse Forms ("the Service"), operated by Perspective Global Pty Ltd (ACN 697 873 368, ABN 34 697 873 368) ("we," "our," or "us"), is a contact-form and form-backend routing service. When someone fills in a form powered by PixelVerse Forms, the submission is securely received, stored, and forwarded - as email notifications - to the person or organisation that built the form ("the form creator"). Optionally, an automated receipt is sent back to the email address the submitter typed into the form.

These Terms apply to two groups of people:

• Form creators - individuals or organisations who register an account to build and publish forms.
• Respondents - anyone who fills in and submits a form powered by PixelVerse Forms (no account required).

By using the Service in either capacity, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. How the Service Works

• Form creators build forms through PixelVerse Forms and embed or share them however they choose.
• When a respondent submits a form, we store the submission and send an email notification to the addresses the form creator has configured to receive it.
• Each submission automatically includes server-side technical metadata - such as IP address, approximate location derived from IP, browser and device type, and referring page - used for spam protection, security, and dashboard analytics (including geographic maps and breakdown charts). • If the form includes an email field and the creator has enabled confirmation emails, we send a single automated receipt to the email address the respondent provided - containing a copy of their own submission. No other emails are sent to respondents.
• PixelVerse Forms does not maintain subscriber lists, send marketing emails, or allow form creators to contact people who have not submitted a form. The email system is entirely reactive: it only fires in response to a submission, and only to addresses directly involved in that submission.
• The content of a form, the questions asked, and how submitted data is subsequently used are entirely the responsibility of the form creator.

2. Form Creators - Account & Responsibilities

• You must be at least 16 years of age to register an account.
• You are responsible for all activity that occurs under your account and for keeping your credentials secure.
• As a form creator you are the data controller (or, under Australian law, the APP entity responsible) for any personal information collected through your forms. You are solely responsible for ensuring your data collection complies with all applicable laws - including the Privacy Act 1988 (Cth) and the Australian Privacy Principles, the Spam Act 2003 (Cth), and any other data-protection law applicable to your respondents (such as the EU/UK GDPR where respondents are located there).
• You must make clear to respondents what their information will be used for, and obtain any consent required by law. This includes disclosing that PixelVerse Forms automatically captures technical metadata with each submission (IP address, approximate IP-based location, browser/device details, and referrer) as described in our Privacy Policy. Hosted forms link to our policies by default, but you remain responsible for any additional notices required for your specific collection and use of respondent data.
• You must not create forms intended to deceive, impersonate, or harvest data from respondents unlawfully.

3. Respondents - Submitting a Form

• Submitting a form does not create an account or any ongoing relationship between you and Perspective Global Pty Ltd.
• Your submission is routed to the form creator. If you provided an email address, you may receive a single automated receipt containing a copy of what you submitted - nothing else.
• By submitting a form you acknowledge that we automatically collect technical metadata with your submission (including IP address, approximate location from IP, browser/device information, and referrer URL) as described in our Privacy Policy. We do not use this data for advertising or cross-site tracking.
• You are responsible for the content you submit. By submitting a form you confirm that the information you provide is truthful and that you are the legitimate owner of any email address you enter.
• To request access to, correction of, or deletion of data we hold, contact support@pixelverse.tech. We cannot delete data that has already been delivered to the form creator's own systems.

4. Acceptable Use

Neither form creators nor respondents may use the Service to:

• Submit, publish, or transmit content that is unlawful, defamatory, obscene, threatening, harassing, or otherwise objectionable.
• Infringe any intellectual property, privacy, or other rights of any person or entity.
• Impersonate any person, organisation, or entity.
• Collect personal data without a lawful basis or in violation of applicable data-protection law.
• Interfere with or disrupt the integrity or performance of the Service.

5. Abuse & Spam Policy

Because every submission triggers real emails and stores real personal data, abuse of the pipeline causes direct harm. The following are strictly prohibited:

For respondents submitting forms:

• Spam submissions: Sending repeated, bulk, or automated submissions to a form - including using bots, scripts, or other automated tools - for the purpose of flooding a form creator's inbox or disrupting the Service.
• Third-party email abuse: Deliberately entering someone else's email address into a form's email field in order to cause an automated receipt to be sent to them without their consent.
• Harmful content: Submitting content that contains or links to malware, viruses, phishing material, or that is intended to harm the form creator or any other party.
• Harassment: Using form submissions to send abusive, threatening, or harassing content to form creators.

For form creators:

• Deceptive forms: Building forms that misrepresent their purpose or impersonate another organisation in order to trick respondents into disclosing sensitive information (passwords, payment details, etc.).
• Unlawful data collection: Creating forms that collect personal data without a legitimate legal basis or that violate applicable data-protection law.
• System abuse: Attempting to circumvent the honeypot or other anti-spam measures built into the Service, or otherwise exploiting the platform in ways not intended by its design.

To report a form or submission you believe is abusive, contact abuse@pixelverse.tech. We review all reports promptly.

6. Email Receipts

• When enabled by the form creator, an automated receipt email is sent to the email address provided by the respondent in the form. This email contains only a copy of that respondent's own submission - no marketing, no additional content.
• All emails sent through the Service carry PixelVerse Forms branding in the footer. This is required and cannot be removed.
• We reserve the right to suspend email delivery for any form generating unusual activity, excessive bounce rates, or signals of abuse.

7. Our Role as Data Processor

• PixelVerse Forms processes respondent data solely to operate the Service described in these Terms and in our Privacy Policy - including receiving and storing submissions, sending notifications, spam and abuse prevention, and providing form creators with submission history and aggregated analytics (such as geographic, device, and referrer breakdowns).
• We do not sell, rent, or exploit submission data for advertising or unrelated commercial purposes.
• Form creators who require a data processing agreement to meet their own compliance obligations (whether under Australian law or the GDPR) may request one at support@pixelverse.tech.

8. Intellectual Property

• The Service, including its design, code, branding, and documentation, is owned by Perspective Global Pty Ltd. You may not copy, modify, or distribute it without our express written permission.
• Form creators retain all rights to the forms and templates they create. By using the Service, you grant us a limited licence to host, process, and transmit that content solely to operate the Service.

9. Service Availability & Modifications

• We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability. The Service is provided on an "as is" and "as available" basis.
• We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
• We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

10. Limitation of Liability

• To the fullest extent permitted by law, Perspective Global Pty Ltd is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Service.
• We are not responsible for the content of any form or submission, or for how a form creator uses data they collect.
• Our total liability for any claim under these Terms shall not exceed the amount paid to us (if any) in the three months preceding the claim.
• Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

11. Termination

• Form creators may close their account at any time by contacting support@pixelverse.tech.
• We may suspend or remove any account or form immediately if these Terms are breached, or if we are required to do so by law.
• Upon termination, access to the Service ceases immediately. Data retention is governed by our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of Australia and of the State or Territory in which Perspective Global Pty Ltd is registered. You and Perspective Global Pty Ltd submit to the exclusive jurisdiction of the courts of Australia in respect of any dispute arising under or in connection with these Terms.
